Availability of our Site

  • Our site is made available free of charge (although charges may apply if you wish to register a private location on our site).
  • We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
  • We do not guarantee that our site will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.  You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored, or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities, and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

  • Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources.

Our responsibility for loss or damage suffered by you

  • Whether you are a consumer or a business user, we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
  • If you are a business user:
    • We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.
    • We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
      • use of, or inability to use, our site;
      • use of or reliance on any content displayed on our site; or
      • the content of any communications sent to you by a third party through our “Send Message By Email” function, or any arrangements facilitated through the use of the “Send Message By Email” function.
    • In particular, we will not be liable for:
    • loss of profits, sales, business, or revenue;
    • business interruption;
    • loss of anticipated savings;
    • loss of business opportunity, goodwill or reputation; or
    • any indirect or consequential loss or damage.
  • If you are a consumer user, please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  • We are not a party to any contract made by you with a Production Company or any other third party which has been introduced to you on our site (or via any third party site) and we shall not be liable to you for any losses or damage suffered (of any kind and whether direct or indirect) as a result of any contract, agreement or arrangement of any form which you enter into with a Production Company or any other third party as a result of the use of our site (or any third party site).

How we may use your personal information

Registering  on the Norfolk Screen Locations Directory

  • When you register on our Locations Directory via SuperScout.ai you will not receive a log in to update or change any of your listings. You must contact Norfolk Screen to do this. 
  • Registration benefits may change and, where possible, will be publicised on the website.
  • Details of any applicable registration fees will be listed on the Norfolk Screen website. Currently we do not charge registration fees for any type of registration on our directories. Norfolk Screen reserves the right to charge a fee in future for existing and further categories of our directories, or to increase the existing registration fees (where applicable) on a yearly basis and you will be informed if this occurs.
  • All those registering their locations via the SuperScout.ai software must be at least 18 years old.
  • We reserve the right to decline any user’s application for a registration for any reason and at our sole discretion and we shall not be required to provide any justification for such decision.
  • In the event that you take out registration in an incorrect category we reserve the right to terminate / or amend your registration with no obligation to repay the registration fee (where one has been paid).
  • For those registering on our Locations Directory, the location you are registering must be located within the County of Norfolk.
  • Norfolk Screen will ensure that it offers free registration to; land buildings owned and directly managed by public authorities, places of worship, museums, National Trust, English Heritage, Broads Authority, Forestry Commission, Lottery funded and Community Run which are used for public purpose.
  • For those wishing to register as Crew or Suppliers, this should be done via our Filming in England partners who will be responsible for holding your data. You must agree to their terms and conditions and privacy policy when joining. Norfolk Screen will hyperlink the Crew and Suppliers Directory directly on the Norfolk Screen website to help advertise and showcase regional talent. Norfolk Screen is not responsible for any registrations you make via this Filming in England site.
  • We shall be permitted to terminate your registration our Locations Directory, amend your information, and/or remove your information from our Locations Directory with immediate effect in the following circumstances:
    • if we believe (in our sole discretion) that false statements were made by you when registering on our site;
      • in the case of loss or suspicion of misuse of the access data by you or any person acting on your behalf;
      • if you have breached any of these terms of use; or
      • if any serious act committed by you gives us reasonable grounds for so doing; and
    • if Norfolk Screen CIC ceases to operate as an organisation we will cancel your registration, and any registration fees you have paid will be non-refundable.
  • If you have registered as Crew or Suppliers with Filming in England, we may also advise Filming in England that you should be de-listed in the event that the matters set out in the bullet point above apply.
  • We shall not offer refunds for any registration fees you have paid if your registration is cancelled.
  • You shall be permitted to cancel your registration with us and remove your information from our site at any time. To do so, please email info@norfolkscreen.co.uk. However, please note that any registration fee you have paid will remain non-refundable.
  • You acknowledge that by registering and purchasing this selection with us you are not guaranteed to receive any offers of work or opportunities to provide services to third parties.

Terms of your Location Directory Registration

  • Your registration will commence on the date on which we email you to confirm that we have accepted your application (the “Commencement Date”).
  • Unless your registration is terminated earlier in accordance with these terms, your registration will be for an initial period of one year from the Commencement Date and shall renew for further periods of one year if you do not cancel your registration before the end of each year.
  • For the avoidance of doubt, we shall be under no obligation to agree to a renewal of your registration, and we shall be permitted to reject any request for a renewal at our sole discretion.

Payment of registration fees

  • If you are required to pay registration fees in order to register on our Location Directory, the full amount of the registration fees for the relevant year shall be payable in advance on the Commencement Date, and then prior to each anniversary of the Commencement Date.
  • We accept payment of the registration fees either by:
    • direct debit;
    • debit or credit card payment; or
    • such as payment method as listed on our site from time to time.
  • If either of us ends your registration during a period in which you have paid registration fees in advance, then we will not refund you for the registration fees which relate to any period after your registration has ended.

We may transfer this Agreement to someone else

  • We may transfer our rights and obligations under these terms to another organisation. We will always tell you in writing if this happens and we will ensure that the transfer will not affect your rights under the contract.
  • In particular, we have engaged a third party, SuperScout.ai , on a sub-contracted basis in relation to the hosting and management of our Locations Directory (public & private locations).  
  • By registering with us as a public or private location, you agree that we shall be permitted to use SuperScout.ai to perform certain functions on our behalf. However, the contract for our services will at all times remain between us and you. 
  • If you register with us, you will create a user identification code or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
  • We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.
  • If you know or suspect that anyone other than you who knows your user identification code or password, you must promptly notify us at info@norfolkscreen.co.uk.

Which country’s laws apply to any disputes?

  • If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
  • If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
